1. Acceptance of Terms

By accessing or using the website at corsicanadeckandfence.com (the "Site") or by engaging Corsicana Deck & Fence ("we," "us," or "our") for any services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our Site or engage our services. We reserve the right to update these terms at any time, and continued use of the Site or our services following any update constitutes acceptance of the revised terms.

2. Description of Services

Corsicana Deck & Fence provides residential and commercial outdoor construction and installation services in Corsicana, TX and surrounding areas, including but not limited to:

• Custom deck design and construction
• Composite, Trex, pressure-treated, and cedar deck installation
• Deck repair, replacement, staining, and sealing
• Vinyl, wood, and privacy fence installation
• Screened-in porches, covered decks, pergolas, and patio covers
• Pool decks, outdoor kitchens, multi-level decks, and railing installation

The availability of specific services is subject to project scope, location, materials availability, permitting requirements, and our current capacity. We reserve the right to decline any project at our discretion.

3. Estimates and Pricing

All estimates provided by Corsicana Deck & Fence are based on information available at the time of the site visit and written proposal. Estimates are not guaranteed final prices until a written contract is signed by both parties.

Estimates may be subject to change if:

• Site conditions discovered during construction differ materially from what was visible during the estimate visit.
• The scope of work is changed or expanded at the customer's request after contract execution.
• Material costs increase significantly due to supply chain conditions outside our control after the contract is signed.
• Permit requirements or inspection findings require additional work.

Any change in price will be communicated to you in writing before additional work is performed. We will not perform work beyond the original contract scope without your written authorization.

4. Scheduling and Cancellation

Project start dates are scheduled after contract execution and deposit receipt, subject to permit approval timelines and our current workload. We will provide a written estimated start date and make reasonable efforts to meet it. Weather delays, permit delays, and material availability may affect the schedule. We will notify you promptly of any significant schedule changes.

If you need to cancel or postpone a scheduled project, please notify us as soon as possible. Cancellation terms - including any deposit refund or retention policy - are set forth in the written contract executed for each project. In general:

• Cancellations made before materials are ordered may be entitled to a full or partial deposit refund as specified in the contract.
• Cancellations after materials have been ordered or work has begun may result in forfeiture of the deposit and additional charges for materials and labor already expended.

5. Payment Terms

Payment terms are established in each individual written contract. In general, our standard payment structure requires:

• A deposit upon contract execution to secure materials and scheduling.
• Progress payments as specified in the contract at defined project milestones.
• A final payment upon project completion and customer walkthrough.

All amounts are due in full by the date specified in the contract. Unpaid balances past their due date may be subject to interest or collection proceedings. We accept payment methods as listed in each individual contract. Disputed invoices must be communicated to us in writing within five business days of receipt.

6. Permits and Inspections

Where required by local ordinance, Corsicana Deck & Fence will obtain necessary building permits on behalf of the customer. Permit fees are the responsibility of the customer and will be included in the written contract or billed separately as they are incurred. We will schedule required inspections and ensure that work is completed to the standards necessary to pass inspection. Delays caused by permitting authorities or inspection scheduling are outside our control and do not constitute a breach of contract.

7. Warranty Disclaimers

Corsicana Deck & Fence warrants that all work will be performed in a professional manner consistent with industry standards. Specific warranty terms covering workmanship and materials are set forth in each written contract.

Warranties do not cover:

• Damage caused by customer misuse, neglect, or failure to perform recommended maintenance.
• Damage caused by acts of nature, including storms, flooding, or extreme weather events.
• Normal wear and weathering of materials over time.
• Pre-existing conditions on the property that were disclosed or visible at the time of the estimate.
• Work performed or modified by parties other than Corsicana Deck & Fence after project completion.

Manufacturer warranties on materials (composite decking, fasteners, railing systems, etc.) are separate from our workmanship warranty and are subject to each manufacturer's own terms. We will assist you in understanding and registering applicable manufacturer warranties where possible.

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Corsicana Deck & Fence shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to our services or your use of our Site, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from our services shall not exceed the total amount paid to us for the specific project to which the claim relates. Some jurisdictions do not allow limitations on certain types of damages, so some of these limitations may not apply to you.

9. Customer Responsibilities

• Provide accurate and complete information about the project site and your requirements.
• Ensure clear access to the work area on scheduled work days.
• Disclose any known underground utilities, easements, property lines, or HOA restrictions that may affect the project.
• Obtain any HOA or neighborhood association approvals required before work begins, if applicable.
• Make payments according to the schedule specified in the contract.

10. Intellectual Property

All content on the Site - including text, images, graphics, and design elements - is owned by or licensed to Corsicana Deck & Fence and is protected by copyright and other applicable laws. You may not reproduce, distribute, or use our content for commercial purposes without our prior written consent.

11. Dispute Resolution

We are committed to resolving disputes fairly and promptly. If you have a concern about our services, please contact us first at the information below. We will make a good-faith effort to resolve any complaint within a reasonable time.

If a dispute cannot be resolved through direct communication, the parties agree to attempt mediation before pursuing litigation. Any legal action not resolved by mediation shall be brought exclusively in the state or federal courts located in Navarro County, TX, and both parties consent to personal jurisdiction in those courts.

12. Governing Law

These Terms and Conditions and any disputes arising from your use of our Site or our services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
